Handling environmental cases in administrative courts: Lithuania

 

European and comparative administrative law blog (REALaw) prof. Dr. J. Paužaitė-Kulvinskienė (VU) and doc. dr. I. Žvaigždinienė (VU) present the insights of their research on how administrative courts in Lithuania assess the legality and reasonableness of administrative decisions made by state institutions in environmental cases. By reviewing the jurisprudence of the courts in recent years, it was assessed how the balance between the discretion of the public administration institutions and the competence granted to the courts is ensured. This presentation is based on a cross-national comparative study published in full in the book “EU Environmental Principles and Scientific Uncertainty before National Courts”, see more here. The book explored the jurisprudential dynamics of how courts across Europe and beyond analyze and evaluate scientific information presented in environmental cases.
